Aurora Rep. Juan Edgardo Angara, prosecution spokesman, said that the House Prosecution team will highlight Chief Justice Renato Corona's "lack of moral fitness" to keep his post during today's closing arguments.
He said this is because Corona admitted that he did not declare at least 80 million pesos and 2.4 million dollars in his Statements of Assets, Liabilities and Net Worth (SALN).
Expected to deliver the panel's closing statement is Iloilo Rep. Niel Tupas Jr, the lead public prosecutor, according to a report by GMA News.
In his testimony last Friday, Corona said that he did not declare the $2.4 million in his SALN because dollar accounts are confidential, according to Republic Act 6426 or the Foreign Currency Deposits (FCD) Act. In addition, P80 million were not declared because they were commingled accounts – that of his wife's family corporation, the Basa-Guidote Enterprises Inc. (BGEI) and his children's.
Angara labelled as "unbecoming of a public official" Corona's invocation of the FCD law as an exception to his duty under the Constitution and various laws to disclose his assets.
He hopes that the Senate "will uphold the evidence and decide what is best for the country going forward."
On the other hand, lead defense counsel Serafi Cuevas said that Corona did not violate the Constitution.
Today, both sides will be given an hour to deliver their closing statements.
DECISION
Meanwhile, Senate Majority Leader Vicente Sotto III said that the verdict might be handed down on Tuesday after all the oral arguments are made today.
He said, this way, senator-judges will have time to think of the arguments raised by both sides.
He said the court will resume at 2 p.m. today and Senate President Juan Ponce Enrile, the court presiding officer, will declare the case submitted for resolution.
He added that Articles 2, 3 and 7, will be voted separately. However, if a "guilty" verdict is made on the first round of Article 2, the court will not proceed to Article 3. The same way with Article 3, when a "guilty" verdict is made, voting for Article 4 will not be pursued.
Article 2 points to Corona's alleged failure to fully disclose his assets in his SALN.
VERDICT
In an abs-cbnnews.com report, Dean Joe Bisquera, vice-president for legal affairs at the University of Manila, predicted a "guilty" verdict against Corona. He claimed 8 "swing votes" are likely to go for conviction.
The report said that Bisquera sees 19 senator-judges voting "guilty," 3 more than the 16 votes required for a conviction.
He reportedly said that 11 senators will vote "guilty" and eight will have swing votes, who by today, will also vote the same.
Bisquera named the 11 senators as: Franklin Drilon, Francis Escudero, Teofista Guingona III, Serge Osmeña, Ralph Recto, Francis Pangilinan, Ramon "Bong" Revilla Jr., Panfilo Lacson, Aquilino Pimentel III, Antonio Trillanes IV and Jinggoy Estrada.
He predicted only four votes for Corona's acquittal -- Miriam Defensor-Santiago, Ferdinand Marcos Jr., Manny Villar and Joker Arroyo.
Bisquera said he based his analysis on the senators' personal conviction, political commitment to the Aquino administration, and their political plans.
Valdez said the verdict will be based on the evidence presented and not on political affiliation. He also believes that in the end, senator-judges will vote based on conscience.*with reports from GMA News and InterAksyon.com
